Oxnard Police Department Website Terms and Conditions

Please review the following Terms and Conditions. By using the
OxnardPD.org Website (the “Site”), you hereby
agree to be bound by all of the Terms and Conditions contained herein.

PURPOSE
The City of Oxnard (“City”), through its Police Department
(the “Department”), has created and designed the Site for the
purpose of communicating general information with users of the Site and
the residents of the City.
The Site is not intended for emergency use and is not a replacement for
using 9-1-1 or calling the Department directly. If you have an emergency or
important time-sensitive information and are within the City of Oxnard
(“City”) limits, communicate this information with the Department
by using 9-1-1 emergency telephone service.

PROPRIETARY RIGHTS
The Department retains copyright on all text, graphic images, and other
content (the “material”) on the Site. The material published
on the Site is protected by copyright and other intellectual property laws,
and is owned or controlled by the Department, or the party listed as the
provider of the content, software, or other materials. Commercial use of
the materials is prohibited without written permission of the Department.
UNAUTHORIZED COPYING, REPRODUCTION, REPUBLISHING, UPLOADING, DOWNLOADING,
POSTING, TRANSMITTING OR DUPLICATING ANY OF THE MATERIAL IS PROHIBITED.
You may download or copy any downloadable material displayed on the Site
for home, noncommercial, and personal use only, provided that you maintain
all copyright, trademark, or other notices contained in the material and
you agree to abide by all additional copyright notices, trademark notices,
information, or restrictions contained in any material accessed through the Site.
Use of the name or insignias of the Department is restricted by law and
may be used only with written permission of the Department.

DEPARTMENT’S RIGHT TO MODIFY THE TERMS AND CONDITIONS
The Department reserves the right to modify, update, or alter these
Terms and Conditions at any time. Your continued use of the Site
constitutes your agreement to comply with such modifications, updates,
or alterations of the Terms and Conditions.

GOVERNING LAW
These Terms and Conditions shall be governed by, construed and enforced
in accordance with the laws of the State of California as applied to
agreements made and to be performed entirely therein. Any action brought
to enforce these Terms and Conditions or in connection with this Site
shall be brought in either the state or federal courts in Ventura
County, California.

LEGAL NOTICE
Communications made through or to the Site’s e-mail and messaging
system shall in no way be deemed to constitute legal notice to the City,
its City Council, or any of its departments, including the
Department, divisions, officers, employees, agents, or representatives,
with respect to any existing or potential claim or cause of action
against the City, its City Council, or any of its departments, divisions,
officers, employees, agents, or representatives, where notice to the City,
its City Council, or any of its departments, including the Department,
divisions, officers, employees, agents, or representatives is required
by any federal, state, or local laws, rules, or regulations.

AUTHORIZED PURPOSES
The Site shall be used only for authorized purposes. Unauthorized
modification of any information stored on this system may result in
criminal prosecution under Federal, State, and local laws. The
Department and its agents may monitor and audit the usage of the
Site, and all persons are hereby notified that use of the Site
constitutes consent to such monitoring and auditing.
You shall not restrict or inhibit any other user from using and
enjoying any service conducted on this Site, nor shall you upload,
transmit, distribute, or otherwise publish on the Site (i) any
unlawful, threatening, abusive, defamatory, obscene, vulgar,
pornographic, profane, or indecent materials; (ii) any materials
which infringe any intellectual property right of any third party
or advertise or otherwise solicit funds or is a solicitation for
goods and services; or (iii) any materials containing a virus or
other harmful component. While the Department has no obligation
to monitor the Site and is not responsible for the content of
any messages, information, or files transmitted on the Site, the
Department reserves the right to delete, move, edit, refuse to
post, or take other appropriate action with respect to such messages,
information or files which the Department, in its sole discretion,
deems objectionable or otherwise in violation of these Terms and Conditions.

DISCLAIMERS/LIMITATION OF LIABILITY
The material included on or available through the Site may include inaccuracies or
typographical errors. Changes are periodically added to the material on the
Site. The Department may make improvements and/or changes to the Site at any time.
The Department does not represent or warrant that the Site will be uninterrupted
or error-free, that defects will be corrected, or that the Site or the server
that makes it available, are free of viruses or other harmful components. The
Department makes no representation about the suitability, reliability, availability,
timeliness, or accuracy of the Site for any purpose. The Site and the material
contained herein are provided “as is” without warranty of any kind.
The Department hereby disclaims all warranties and conditions with regard to the
Site, including all implied warranties and conditions of merchantability, or fitness
for a particular purpose, title, and non-infringement.

STATISTICS
The Department may collect and store information for statistical purposes. For
example, the Department may count the number of users to the different sections
of the Site to help make those sections more useful to users. Similar
information is gathered for anonymous ftp, remote account login, or for other
comparable types of connections.

PRIVACY
By sending the Department an electronic mail message, you may be sending the Department
personal information, such as your name, mailing address, telephone number, and/or
e-mail address. The Department may store this information in order to respond to a
request or to otherwise resolve the subject matter of your e-mail. The Department
does not sell, trade, or rent your personal information to others. The Department
does not send unsolicited e-mail or correspondence. The Department makes every
reasonable effort to ensure that your identifying information is not disclosed to
outside sources, except that if the Department suspects criminal activity, your
information may be shared with personnel of the Department or other allied law enforcement
agencies. If you are concerned about your privacy or anonymity, the Department

The Department does not guarantee the accuracy, reliability, or confidentiality of
any such communications. The Internet should not be used to transmit any sensitive or
confidential information to the Department, as such information may be easily intercepted.
Given the unreliable nature of Internet communications, information transmitted to the
Department via electronic means may not be received, nor may it be received or reviewed
in a timely manner, although the Department makes every reasonable effort to respond to
messages received.
