Areas for Potential Disqualification from Police Employment

The Oxnard Police Department has the right and obligation to obtain assurances that all candidates applying for employment at the Police Department (which means any position at the Police Department, not just police officers) meet established standards. The following guidelines are representative of the more common disqualifiers. However, other information of facts revealed during the background investigation may also be sufficient to disqualify a candidate. All information in the personal history statement, which the applicant will complete, will be verified by a polygraph examination.

The guidelines below relate to the actual use of illegal drugs and are not intended to exclude those persons who are not illegally using drugs. Each item is marked, "Will" or "May," which means, "Will Disqualify" and "May Disqualify." These guidelines are subject to change without notice (revised January 2000).

GENERAL DISQUALIFY?
Not a U.S. Citizen and have not applied for U.S. citizenship within the past year. WILL
Falsification or deception during the hiring process. WILL
Termination for cause from another police agency. MAY
Unfavorable work history. MAY
Inability to communicate. MAY
Resignation to avoid termination. MAY
SUBSTANCE ABUSE  
Sales of marijuana, drug or narcotic as an adult. WILL
Use of any hallucinogenic. MAY**
Experimentation, extensive or prolonged use of any illegal narcotic within the last three years. WILL
Experimentation, extensive or prolonged use of any illegal drug within the last three years. WILL
Experimentation, extensive or prolonged use of marijuana within the last year. WILL
Extensive or prolonged alcohol abuse without intervention within the last three years. WILL
Experimentation, extensive or prolonged use of steroids within the last three years. MAY
Knowingly remaining in a place where marijuana, illegal drugs or illegal narcotics are used or sold. MAY
CRIMINAL / OTHER  
Commission of a crime involving moral turpitude*. MAY**
Drunk driving within the last three years. MAY
Two or more moving traffic violations within the last two years. MAY
Attempted Suicide. MAY
Presently on probation. MAY
Commission of a crime of violence within the past ten years. WILL
MEDICAL / PSYCHOLOGICAL  
As determined by the City of Oxnard Police Department medical and psychological standards. WHERE
APPLICABLE

*Moral Turpitude
“Generally, a crime involving dishonesty or false statement is considered to be one involving moral turpitude.” [United States v. Gloria, 494 F.2d 477 (5th Cir. 1974), cert. denied, 95 S.Ct 306 (1974)]

“An act or behavior that gravely violates moral sentiment or accepted moral standards of community, and is a morally culpable quality held to be present in some criminal offenses as distinguished from others.” [Black's Law Dictionary: 1979]
